 Result –Not Guilty

Client was stopped for crossing over into the oncoming lane on a few occasions.  The police observed this and stopped the client.  The officer observed the client to have an odor of alcohol, red glassy eyes and slurred speech.  Although, the Client’s second language was English.  The officer asked the client to exit the vehicle where further field sobriety tests were performed.  The client did not do well on these exercises.

On cross examination of the officers they admitted that the client did have difficulty understanding the instruction so they demonstrated certain portions of the tests.  More importantly, the client had a witness who worked with the client and joined the client for 3 beers after work.  The witness was able to provide a credible account of the evening and to verify that the clients English was not good and they commonly spoke in their native language.  The jury acquitted the client of the OUI allegation.
